Moving to Spain is not a one-size-fits-all decision.
Behind the idea of “_living in Spain_” lie very different personal, family and professional realities—and each of them leads to a different residence pathway.

One of the most common mistakes we see is trying to fit into a specific permit before analysing the real purpose of the move, available resources and medium-term plans.

This guide is designed to help you understand **which residence option best aligns with your profile**, before starting any application or seeking personalised legal advice.

#### There Is No “Best” Residence Permit—Only the Right One for You

Spanish immigration law offers many legal pathways.
The challenge is not choosing between many, but choosing the **one that matches your circumstances and long-term project.**

To help you get oriented, we have grouped the most frequent situations into **four clear profiles**, each linked to the most suitable residence options.

#### Profile 1 · Living in Spain Without Working: Stability and Family Plans

This profile includes:
- Retired individuals
- Families with sufficient financial means
- Parents seeking education opportunities for their children in Spain
- People with stable income from abroad

Since there is no need to work in Spain, the most appropriate option is usually the **[Non-Lucrative Residence Permit](/en-us/knowledge/non-lucrative-residence)**, ideal for those who want to live in Spain long-term without engaging in professional activities.

#### Profile 2 · Starting a Business or Investing in Spain

This category applies to people whose main goal is to **[develop a business or professional project](/en-us/knowledge/residence-permit-to-develop-a-business-project)** in Spain, or diversify their investments internationally.

Typical cases include:
- Entrepreneurs launching a project in Spain
- Self-employed professionals providing services locally
- Investors exploring opportunities in the Spanish market

These applications require a careful analysis of the business model, economic viability and legal compliance.

The most common residence options are:
- Self-Employed Work and Residence Permit
- Investor Residence Permit (closed to new applications since 3 April 2025)

#### Profile 3 · International Professionals, Remote Workers and Global Mobility

Spain now offers specific categories for professionals who work remotely or for companies abroad.

This includes:
- Digital nomads
- [Highly qualified professionals](/en-us/blog/visa-for-highly-qualified-workers)
- Freelancers with international clients

The key questions are:
Where is the work performed? Who pays for it? How is income generated?

Depending on the answers, the most suitable options may be:
- Digital Nomad Visa and Residence Permit
- Residence for Highly Qualified Professionals
- Employee Work and Residence Permit (ideally within the Shortage Occupation List)

#### Profile 4 · Studies, Training and Temporary Stays with Future Plans

For many people, the student route is the most accessible way to begin living in Spain, especially when the initial goal is educational or exploratory.

Suitable for:
- University students
- Master’s, PhD and postgraduate students
- Language learners

Study stay permits include:
- [Legal residence during studies](/en-us/blog/visa-to-stay-for-studies-what-is-the-study-permit)
- Authorisation to work up to 30 hours per week
- The possibility, in some cases, to bring family members

Later, this stay can often be modified into a work-related residence permit.

#### Other Common Scenarios: Family, Reunification and Accompanied Mobility

Some cases require a tailored analysis, such as:
- [Family reunification](/en-us/knowledge/family-reunification)
- Relatives of Spanish or EU citizens
- Students wanting to bring family members
- Spouses or partners of residents

These options often complement the main residence pathway rather than replace it.

#### Choosing the Right Path from the Beginning Saves Time, Money and Stress

Every case is unique. What worked for someone else might not be the right option for you.

A well-chosen strategy from the outset:
- Reduces the risk of a refusal
- Avoids unnecessary changes
- Builds a stable, sustainable long-term plan

Currently both the Law and the Aliens Regulations collect a multitude of cards and authorizations to live and work in Spain. We will see throughout this article what are the economic means to be credited in some of them.

## Non-profit residence

Regarding the accreditation of sufficient economic means, the following minimum monthly amounts are established:

- 400% of the IPREM, or its legal equivalent in foreign currency for the applicant, and
- 100% of the IPREM or its legal equivalent in foreign currency for each of the relatives that the applicant has in his charge.

The **IPREM** is the (Public Indicator of Income of Multiple Effects) and the reference amount in 2021 is 564.90 euros per month, a value that corresponds to a total annual income of 6,778.80 euros without extraordinary payments and 7,908.60 euros with extraordinary payments.
It should be borne in mind that, each year this indicator is revalued so that the calculation must be made according to the authorization period that is intended to be requested.

Considerations: _There is an important point to highlight in this type of applications, the accreditation of having sufficient economic means can be made by any means of valid proof in Law_ that allows to prove the periodic income or the possession of sufficient patrimony that guarantees the stay of the applicant without depending on the public administration, nor to carry out work activities in the Spanish territory.

Included for the accreditation of these economic means are the contribution of **property titles, certified checks or credit cards, accompanied by a bank certification** where the amounts available to the applicant are accredited. You may also have shares or participations in Spanish, mixed or foreign companies proving by means of an affidavit that no work activity is carried out in them.

It is important to emphasize that Spanish legislation does not require that no work activity be carried out, but that it **cannot occur in Spanish territory**.

In addition, there is the possibility that the person travels periodically to his country to be able to attend to his business, as long as the effective residence in Spain is maintained.

On the other hand, it must be taken into account that the maximum term of this initial authorization is 1 year, without prejudice to the fact that, when requested for periods of temporary residence less than one year, the requirement of the economic means will be proportional to the period for which the non-profit residence is requested and that it would be logically less than that corresponding to the period of 12 months provided for in the initial application.

## Reagrupación familiar.

Many are foreigners who live in Spain legally and want to reunite their family. Nowadays this process of family reunification is somewhat complicated and has become a procedure that requires compliance with certain requirements, and a file that involves the management of many documents, including the economic accreditation that follows.

For family units formed by two people, 150% of the IPREM will be required. For this year 2021 the IPREM amounts to 564.90 euros. That is, if you live in Spain and want to regroup a relative, you must prove at least 847.35 euros per month.

To this must be added 50% of the IRPEM for each additional family member who wants to regroup. That is, if you live with your spouse in Spain and you want to regroup a child, you must add to those 8847.35 euros the amount of 282.45 euros (you must prove that you have at least 1129.8 euros approximately each month).

In order to prove the availability of these economic resources , for example, all the documentation that proves that you have employment and / or sufficient economic resources to meet the needs of the family may be provided.

Another aspect that the Aliens Office will take into account to grant family reunification is that the economic means are stable and continuous for at least six months prior to the request for our family reunification.

## Community card

The Community Family Member Card, or better known as the Community Card, is a residence card that can be applied for by family members of a Spanish citizen or of another Member State of the European Union, or of another State party to the Agreement on the European Economic Area or Switzerland, who do not hold the nationality of one of those States, when they meet him or accompany him, and go to reside in Spain for a period of more than three months, but what economic means do I have to prove to obtain this card?

The rule to be able to access this Community Card is to have for yourself and for the members of your family, **sufficient economic resources** so as not to become a burden for social assistance in Spain during your period of residence. You must also provide public or private health insurance, contracted in Spain or in another country, that provides coverage in Spain during your period of residence equivalent to that provided by the National Health System.

In relation to this requirement (proving sufficient economic means), the regulations do not contemplate a specific amount to be accredited by the Community so that this requirement is understood to be met. In this case, therefore, the amounts required for **family reunification** under the general scheme apply mutatis mutandis. In this case, if the family unit is composed of two family members, it will be necessary to prove that we have € 10,167 per year. For each additional member to that family unit we must add the amount of € 3388.2 per year.

## Study visa.

Financial resources must be credited for an amount equivalent to 100% of the IPREM for each of the months that comprise the period of studies. It will necessarily be accredited with the presentation of the following documents in the following cases:

#### The applicant who proves economic solvency with his own means
- Last three bank statements.
- Three last settlements of own salary.
- Additionally, the above economic information can be supplemented with other official bank documents such as: savings accounts, term deposits or mutual funds.
- Exceptionally, the granting of a credit may be considered as a means of economic support. In this case, the credit must be credited to the applicant's current account. Documentation relating to the granting of such credit must be submitted.

#### The applicant who proves economic solvency with family means (father, mother, legal guardian, other relatives):
- Apostilled notarial declaration of the family member (declarant) who undertakes to finance all the studies and the stay in Spain of the visa applicant for an amount equivalent to 100% of the IPREM for the entire period of the studies.
- Photocopy of the Identity Card or Passport of the declaring relative.
- Apostilled birth certificate of the visa applicant.
- Three last bank statements.
- Three last salary settlements of the declaring relative

#### The applicant who accredits economic solvency with a scholarship:
By means of an official letter duly stamped and signed, stating the granting of the scholarship by the entity that grants it and where the amount granted is expressed. If the amount granted satisfies the economic resources required, it will not be necessary to provide the documentation indicated in the previous sections. The granting of non-pecuniary amounts (tickets or others), will not be considered as a financial contribution.

## Schengen visa or enter the Schengen area.
If it is decided to travel to a Schengen country, the financial readiness to deal with the existential costs during the period of staying abroad must be demonstrated.

The Embassy or Consulate of the Schengen country to which you plan to travel, among other things when applying for the visa, will ask for some supporting documents to be provided, one of which is "means of subsistence". This is a document accepted to demonstrate that the applicant who wishes to enter a Schengen country, has the necessary financial capacity to travel and reside abroad in the specific country of the Schengen area, complying with the standard of living of that Schengen host country.

Generally, there are several recognized ways to demonstrate your financial sufficiency:
- A personal bank statement indicating financial movements (for at least the last 3 months)
- Credit card
- Cash
- Payroll
- Proof of employment
- Etc

To come to **Spain**, as far as the **European Commission** reports, under the Order of the Ministry of the Presidency of Spain (PRE / 1282/2007), a foreigner who intends to enter the territory of Spain must prove to have at least € 100 / day, with a minimum of € 900 per person regardless of the expected duration of the stay. The foreigner must prove possession of this amount to the Embassy or Consulate of Spain at the time of applying for the Spanish visa.

## **It is now official: Spain activates a new regularization for foreign nationals in an irregular situation**

**It is now official.** Spain has published in the Official State Gazette the Royal Decree 316/2026, of April 14, which introduces a new extraordinary pathway to regularize the situation of thousands of foreign nationals already residing in the country.

This is a measure with a major impact which, according to official estimates, could benefit hundreds of thousands of people. However, it is essential to understand a key reality: **it is not an automatic regularization**, but a procedure with specific requirements, fixed deadlines and strict conditions.

The regulation was published on **April 15, 2026** and **enters into force on April 16, 2026**, opening a limited window to apply for these new authorizations.

---

## **What exactly has been approved?**

The Royal Decree introduces two new pathways within the Immigration Regulations:

* An authorization for **applicants for international protection (asylum)**.
* A new type of **extraordinary residency by ties (arraigo)**.

Both pathways are exceptional and can only be applied for until **June 30, 2026**.

From Aray Asociados we remind that this is a one-off measure, not structural, so **those who do not act within the deadline will lose this opportunity**.

---

## **Who is this regularization aimed at?**

### **1. Applicants for international protection**

Aimed at individuals who:

* Applied for asylum before **January 1, 2026**.
* Are in Spain.
* Do not have another residence authorization.
* Meet security and background requirements.

### **2. Extraordinary residency by ties (arraigo extraordinario)**

Aimed at foreign nationals who:

* Were in Spain before **January 1, 2026**.
* Are in an irregular situation.
* Do not have a valid or pending authorization.

Additionally, they must prove **at least one of the following situations**:

* Having worked or having a job offer.
* Having family ties in Spain.
* Being in a proven vulnerable situation.

---

## **General requirements**

For both pathways, the key requirements are:

* Being in Spain at the time of the application.
* Not having a valid residence or stay authorization.
* Not being in the process of renewing or modifying another authorization.
* Proving residence in Spain.
* Having no relevant criminal record.
* Not posing a risk to public order or security.

An important point: **cancelable criminal records will not prevent access**, which opens the door to many cases that were previously automatically excluded.

---

## **Required documentation**

The basic documentation includes:

* Full passport (even if expired).
* Criminal record certificate from the country of origin and countries of residence for the last 5 years.
* Proof of residence in Spain.

In the case of extraordinary residency by ties, additionally:

* Documentation proving work, job offer or economic activity.
* Proof of family ties.
* Vulnerability report (if applicable).

This is where most applications fail: **the law is not the complicated part, proving what the law requires is**.

---

## **Application procedure**

The application may be submitted:

* In person.
* Online.
* Through a legal representative.

It will be processed at:

* Immigration Offices.
* Social Security Offices.
* Authorized offices (including the postal service).

The procedure will be specific and expedited, managed by the **Immigration Processing Unit**.

---

## **Key deadlines**

* **Start:** April 16, 2026
* **End of applications:** June 30, 2026
* **Decision:** up to 3 months
* **Administrative silence:** negative

This means something very clear: **there is no room for errors or delays**.

---

## **Can you work while the application is being processed?**

Yes.

One of the most relevant aspects of this reform is that:

👉 From the moment the application is submitted, the applicant is **provisionally authorized to reside and work** in Spain.

This includes:

* Employment.
* Self-employment.
* No limitation by sector or territory.

But be careful: if the application is denied, this authorization automatically disappears.

---

## **Duration of the authorization**

The granted authorization will have a duration of:

👉 **1 year**

During this time, the foreign national will be able to work and reside legally in Spain.

Afterwards, they must **modify their status** to a standard authorization.

---

## **Critical aspects that many will overlook**

This is where most people make mistakes:

* It is not an automatic regularization.
* Not everyone can access it.
* It is not enough to simply submit the application.
* Documentation errors can leave you out.
* In some cases (asylum), it requires renouncing ongoing procedures.

From our experience, these types of processes generate a flood of poorly prepared applications. And that has consequences.

---

## **Frequently Asked Questions (FAQ)**

### **Does this automatically regularize any foreign national?**

No. It requires meeting specific requirements and providing sufficient proof.

### **Can I apply if I already have residency?**

No. It is exclusively for individuals without authorization.

### **Do I need a work contract?**

Not necessarily. You can also qualify through family ties or vulnerability.

### **Where is the application submitted?**

At authorized offices or online.

### **Until when can I apply?**

Until **June 30, 2026**.

### **What happens if I have an expulsion order?**

If the authorization is granted, the procedure may be archived.

---

## **Conclusion: real opportunity, but not for improvisation**

This regularization opens an important door for many people who have spent years in Spain without being able to regularize their situation.

But it is not a simple or automatic process.

From Aray Asociados, we have seen how, in similar processes, **errors in strategy or documentation end up excluding people who actually had the right to apply**.

---

## **Do you need help with your case?**

**Update: Organic Law 1/2025 abolished Spain's investor residence permit (golden visa). No new applications have been accepted since 3 April 2025; permits already granted remain valid and renewals follow the previous rules.**

Many foreigners choose Spain as their new base of operations from which to set up their new project or business. Clear examples of this are the large brands such as Xiaomi installed in Spain in 2017 or Huawei in 2012. The main cities of the country have become some of the most important European centers for entrepreneurs. In that sense, one of the most important requirements to be able to make this trip is to obtain a residence permit.

Due to this, our country has always sought to be at the forefront of national and foreign entrepreneurship with the most innovative laws and projects for the management of nationalities and residences. Spain beat last year, for the seventh consecutive year, since the Entrepreneurs Law was launched in 2013, the granting of golden visas to foreign citizens. In total, 8,061 of these visas were granted last year alone, not counting the others. It represents an increase of 22.6% compared to 2018. Once again, excluding the causes of family reunification or business relocation, the most common case was the purchase of a house valued at more than 500,000 euros.

### APPROVAL OF THE LAW
In 2013, due to the crisis in the country, and the need to have effective entrepreneurship measures for nationals and internationals, Law 14/2013 was published to support entrepreneurs and their internationalization.

The Law came to regulate certain cases in which, for reasons of economic interest, the granting of visas and residence authorizations is facilitated and expedited. The project is fundamentally based on two pillars: the elimination of bureaucracy when starting a business and the development of the venture capital industry.

In relation to measures to promote internationalization, internationalization bonds have been established, making financing more flexible for companies and entrepreneurs abroad. Likewise, it is about attracting foreign talent by speeding up the obtaining of residence permits for economic investors of business projects, entrepreneurs, scientists and foreign professionals transferred for work reasons, among others.

### 1. ADVANTAGES OF THIS LAW FOR FOREIGNERS
#### a. The wide variety of residence visas that it contemplates.

#### b. Much faster application process.
Under the general regulations, the immigration office can take up to 3 months to issue a response when submitting the green card application. That is undoubtedly a long time. However, when applying for any residence permit under the Entrepreneurs Law, the time is greatly shortened. Well, the resolution period is only 10 days.

#### c. Easy renovation
In most cases, to be able to renew your residence card in Spain you must have stayed, at least, 183 days in Spain per year. This is a problem for many foreigners, since they become residents for tax purposes, thus paying taxes as residents.

In other words, if they leave Spain for more than 6 months per year, their card is directly extinguished.

However, the investor visa and those of foreign workers under this law do not require such permanence in order to be renewed. You will only have to visit the country once a year to be able to carry out the procedure.

#### d. Initial card duration
Any residence card under the general immigration regime initially grants one year to live in Spain. Once said period ends, it is possible to renew.

But with a golden visa or an entrepreneur visa this is not the case. The initial residence is directly for 2 years, something that saves a lot of administrative procedures by not having the need to start the renewal so early.

#### e. Possibility of requesting the card from Spain directly
It will not be necessary to start the process from the country of origin. You can directly skip the step of getting the visa to travel to Spain.

With any of these residences it is possible to convert your status as legal directly from Spain, for example with your tourist visa.

#### f. You can come with your family
Another of the most important advantages is the possibility of obtaining residency for your relatives through a joint application.

That is, if you meet all the requirements for any of these visas, you can easily include your family members in your application.

They will also receive an authorization to reside and work in the country.

### 2. VISA CLASSES
We have already seen all the advantages that applying for one of these visas entails. Something that makes it an ideal way to obtain residency in Spain.

But what exactly are those residence permits?

#### a. Golden visa or investor visa
Without a doubt one of the easiest ways to start living in Spain. With the golden visa you will only have to invest € 500,000 in real estate and the residence will be yours. That easy!

However, if you prefer, you can also choose to invest in Spanish companies, buy debt or government bonds. Thus, in those cases the minimum investment can go up to 2 million euros.

#### b. Entrepreneur visa
If you would like to set up your startup in Spanish territory, the entrepreneur visa is for you. It is the card that is granted to foreigners who set up an innovative business that promotes the socio-economic development of the country.

In this case, the requirements are a bit stricter, since a complete business plan is required in which you demonstrate the viability of your project and how it can promote the country's economy, in addition to creating employment.

Keep in mind that setting up a traditional business will not allow you to get an entrepreneur visa. You will have to start something innovative that does not exist yet. Something that uses technology and breaks the market.

#### c. Work permit as a highly skilled worker
Getting a work permit in Spain can be a difficult task. However, as long as you have higher education and receive an offer as a manager / manager or in a technical position, you can opt for the highly qualified visa.

This will avoid the need to go through the dreaded shortage list that governs general work visas.

As an important requirement, you must charge more than € 50,000 per year for your offer to be valid for the application.

#### d.  Permission for intra-corporate transfer
Let's say you work for a multinational company based in Spain. In that case, if you are assigned to Spain for work or professional training reasons, the intra-company transfer visa will be the easiest option for you.

#### e. Residence authorization for internships
On the other hand, students can also benefit from this law.

In case you have finished (or are still studying) during the last 2 years studies of level 6 or higher, you can go from a student visa to a residence permit that will allow you to carry out an internship in Spain.

The application is very simple, can be done completely online, and avoids the need to wait 3 years as a student to obtain a work permit.

#### f.  Researcher visa
Finally, there is a visa created specifically for scientific and research personnel.

A visa for all those who travel to Spain to work in an R&D center or carry out research tasks after an agreement with a public or private entity.

It may also include professors hired by universities or higher education centers.

If you still have doubts or need our team of lawyers at Ara y Asociados to help you get any of these visas, don't think twice.

We are at your complete disposal!
