
Appeal Upheld, Visa Granted|A Denial Is Not the End, but the Beginning of a Good Outcome

In non-lucrative residence visa applications in Spain, receiving a refusal does not necessarily mean that all options have been exhausted.
Recently, our firm intervened in an administrative appeal procedure against the denial of a non-lucrative residence visa. The appeal was upheld during the review phase, and the client ultimately obtained the visa.
In the initial application, the consular authority issued a refusal based solely on the claim that “the purpose of the trip and the applicant’s general circumstances did not offer sufficient reliability.” The resolution did not specify the facts on which this assessment was based, nor did it indicate any elements that could be corrected. This lack of clarity prevented the applicant from understanding the true reason for the denial.
During the appeal phase, our legal team—drawing from administrative procedure principles and legal coherence—demonstrated the insufficient reasoning of the refusal and the impact this had on the applicant’s right to information and to remedy potential deficiencies. At the same time, we systematically proved that the applicant fully met all legal requirements for the non-lucrative residence visa, including sufficient financial means, the regularity of the applicant’s personal situation, and the proper administrative processing of the application.
Following the submission of the appeal, the consular authority re-evaluated the case and ultimately issued a favourable resolution, granting the visa.
