Obtaining a student stay visa in Spain is a procedure that requires a lot of bureaucracy and knowledge to achieve successfully and without additional requirements. However, once achieved, it seems that the student's duty is simply to study. But what happens if I fail the course?
The authorization for the renewal of student stay in Spain can be denied if the foreign student does not show progression in the studies that motivated their permit, as established by Article 40 of Royal Decree 557/2011. It is not valid for the student to be pursuing any studies they wish at an institution if they are not advancing in the original program. The extension must be requested following the legal procedure and demonstrating the passing of exams or fulfillment of continuity requirements.

The stay authorization may be extended annually when the applicant proves that they continue to meet the requirements provided in Article 38, both general and specific regarding the activity for which they were authorized to remain in Spain. However, it is not always necessary to require the successful completion of all the subjects in the course, but at least a minimum progress in relation to the studies that determined the granting of the authorization.
Finally, educational institutions in Spain are obliged to notify the Immigration Office and the National Police if an international student fails to meet the requirements of their visa. This could lead to a review of your immigration status and ultimately to the cancellation of your visa.
